General Terms and Conditions of Boutique Romana, located at Weegbree 25, Hendrik Ido Ambacht, version 3 valid from 01-09-2014
1 General
1.1 These terms and conditions apply to all offers from Boutique Romana. They are publicly accessible and can be found on the Boutique Romana website. We will send you a written copy upon request.
1.2 By placing an order, you agree to the delivery and payment terms. Boutique Romana reserves the right to change its delivery and/or payment terms after the expiration of the term.
1.3 Unless otherwise agreed in writing, general or specific terms or conditions of third parties are not recognized by Boutique Romana.
1.4 Boutique Romana guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.
2. Delivery
2.1 Delivery takes place while stocks last.
2.2 In accordance with the rules of distance selling, if Boutique Romana is delayed or an order cannot be fulfilled or can only be partially fulfilled, the consumer will receive notification within 1 month of placing the order and will then have the right to cancel the order without costs and without notice of default.
2.3 Boutique Romana's delivery obligation will be fulfilled, unless proven otherwise, once the items delivered by Boutique Romana have been offered to the customer once. In the case of home delivery, the carrier's report, including the refusal of acceptance, serves as full proof of the offer to deliver.
2.4 All delivery dates stated on the website are indicative. Therefore, no rights can be derived from these dates.
3 Prizes
3.1 Prices will not be increased during the offer period unless legal measures make this necessary or if the manufacturer implements interim price increases.
3.2 All prices on the website are subject to printing and typographical errors. We accept no liability for the consequences of printing and typographical errors.
3.3 All prices on the site are in Euros and include 21% VAT.
4 Data management
4.1 If you place an order with Boutique Romana, your information will be included in Boutique Romana's customer database. Boutique Romana complies with the Personal Data Protection Act and will not share your information with third parties.
4.2 Boutique Romana respects the privacy of users of the website and ensures that your personal data is treated confidentially.
4.3 Boutique Romana sometimes uses a mailing list. Each mailing includes instructions for removing yourself from this list.
5 Warranty and conformity
5.1 The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations in force on the date the agreement is concluded.
5.2 Any guarantee offered by the entrepreneur, manufacturer or importer does not affect the rights and claims that the consumer can assert against the entrepreneur under the law and/or the distance contract in the event of a failure to fulfil the entrepreneur's obligations.
5.3 The buyer is obligated to inspect the delivered goods immediately upon receipt. If the delivered item appears to be incorrect, defective, or incomplete, the buyer must immediately report these defects to Boutique Romana in writing (before returning them to Boutique Romana). Any defects or incorrectly delivered goods must and can be reported to Boutique Romana in writing no later than 2 months after delivery. Returns must be made in the original packaging (including accessories and accompanying documentation) and in new condition. Use after discovery of a defect, damage occurring after discovery of a defect, encumbrance, and/or resale after discovery of a defect, will completely void the right to complain and return the goods.
5.4 If Boutique Romana finds the customer's complaints to be justified, Boutique Romana will, at its discretion, either replace the delivered goods free of charge or make a written arrangement with the customer regarding compensation, provided that Boutique Romana's liability, and therefore the amount of compensation, is always limited to the invoice amount of the goods in question, or (at Boutique Romana's discretion) to the maximum amount covered by Boutique Romana's liability insurance in the relevant case. Boutique Romana accepts no liability for any other form of damage, including additional compensation in any form whatsoever, compensation for indirect or consequential damage, or damage due to lost profits.
5.5 Boutique Romana is not liable for damage caused intentionally or by gross negligence of non-managerial staff.
5.6 This warranty does not apply if: A) and as long as the purchaser is in default towards Boutique Romana; B) the purchaser has repaired and/or modified the delivered goods themselves or has had them repaired and/or modified by third parties. C) the delivered goods have been exposed to abnormal conditions or have otherwise been treated carelessly or contrary to the instructions of Boutique Romana and/or the instructions for use on the packaging; D) the defect is wholly or partly the result of regulations that the government has imposed or will impose regarding the nature or quality of the materials used;
6 Images and specifications
6.1 All images, photos, drawings, etc., including data regarding weights, dimensions, colors, images of labels, etc., on the Boutique Romana website are approximate only, are indicative, and cannot give rise to compensation or termination of the agreement.
7 Liability
7.1 Boutique Romana is not liable for damage to vehicles or other objects caused by improper use of the products. Before use, read the instructions on the packaging and/or consult our website.
8 Retention of title
8.1 Ownership of all items sold and delivered by Boutique Romana to the purchaser remains with Boutique Romana as long as the purchaser has not paid Boutique Romana's claims under the agreement or previous or subsequent similar agreements, as long as the purchaser has not paid for the work performed or yet to be performed under this or similar agreements and as long as the purchaser has not paid Boutique Romana's claims due to failure to fulfill such obligations, including claims relating to fines, interest and costs, all as referred to in Article 3:92 of the Dutch Civil Code.
8.2 The items delivered by Boutique Romana that fall under the retention of title may only be resold in the context of normal business operations and may never be used as a means of payment.
8.3 The purchaser is not authorised to pledge or otherwise encumber the items subject to the retention of title.
8.4 The purchaser hereby gives unconditional and irrevocable permission to Boutique Romana or a third party to be appointed by Boutique Romana to enter all places where its properties will be located and to take those items with it in all cases in which Boutique Romana wishes to exercise its ownership rights.
8.5 If third parties seize the goods delivered under retention of title or wish to establish or assert rights thereto, the purchaser is obliged to inform Boutique Romana as soon as can reasonably be expected.
8.6 The purchaser undertakes to insure and keep insured the goods delivered under retention of title against fire, explosion and water damage as well as against theft and to make the policy of this insurance available for inspection to Boutique Romana upon first request.
9. Right of Withdrawal
9.1 The withdrawal period, also known as the cooling-off period, is 14 calendar days. The consumer has 14 days after receiving the entire order from the seller to exercise their right of withdrawal and cancel the agreement. Sale items cannot be returned.
9.2 The consumer must return the delivered product to the seller within 14 days after invoking his right of withdrawal, unless the seller has offered to collect the product from the consumer.
9.3 Within 14 days after the consumer has exercised their right of withdrawal, the seller must refund the price of the product, excluding the shipping costs for sending the product to the consumer. The consumer may only demand reimbursement from the seller after the seller has received the product from the consumer, unless the seller has offered to collect the product from the consumer.
Customer Data Sharing
National and/or EU rules set certain limits to how and when you may share customer-identifying information with Klarna. EU regulations state that the customer must have clicked the Klarna option before the Merchant shares any such information. Basically this means you share privacy data when the customers actively chooses the Klarna option in your checkout and Klarna's widget is shown, not before. Our default setup complies with EU regulations. If you operate in another jurisdiction, you must check what kind of setup is permitted before you do the integration.

- Financing: With the financing service from Klarna you can pay your purchase in flexible or fixed monthly installations according to the conditions stated in the checkout. The installation payment is due at the end of each month after submission of a separate monthly invoice by Klarna. - Direct bank transfer: Available in Germany, Austria, Belgium, Italy, Spain, Poland and the Netherlands. Your account will be debited directly after placement of your order.
- Direct Debit: Your account will be debited after shipment of the goods or tickets/ availability date of the service or in case of a subscription in accordance with the timelines communicated. You will be notified about the date(s) by email.
- Card Payments: Available in Sweden, Germany and Austria. The amount will be reserved on your card and will be debited after shipment of the goods or tickets/ availability date of the service. In case of a subscription the amount will be debited in accordance with the timelines communicated.
